Kagan's role in diversity

I have read Kathleen Parker's column, "Gender and Geography," of May 13, arguing that President Obama's nomination of Solicitor General of the U.S. Elena Kagan to the U.S. Supreme Court is not an example of providing diversity because she is from New York City, as are the two current women Supreme Court justices. I have read similar arguments by others lamenting this or that quality not presently represented on the court or by this nominee, and they are ridiculous.

I should point out at the outset that I am a feminist activist, a lawyer without judicial experience, and a Jew.

People have millions of characteristics, and to try to get every characteristic included among nine Supreme Court justices is an impossibility. At this time in our nation's history, the focus is on increasing the participation of women among our Supreme Court justices because women constitute over half our population and currently make up only 22 percent of our Supreme Court Justices, although this country has experienced a revolution in women's legal rights since the mid-1960s.

One of the two women currently on the court is 77 years old and has experienced health problems in recent years. If she were to retire, women would constitute only 11 percent of our Supreme Court Justices. Therefore, for the president to name a brilliant woman with an incredible record of achievement by the age of 50 satisfies the most important element of diversity at this time.

I look forward to her being seated on the court and serving with distinction.
